COPYRIGHT INFORMATION

1. Copyright Ownership
All photographs and edited images remain the exclusive intellectual property of Carina Wu (CW16Photo) unless otherwise agreed in writing. This includes all original captures and post-processed works created using professional editing tools such as Adobe Lightroom.
2. License Grant (Usage Rights)
Following the negotiation and agreement of usage terms and upon full payment, the Client will be granted a non-exclusive, non-transferable license to use the delivered images for the agreed purpose(s) only.
Permitted uses may include:
Personal use (e.g., social media, private display)
No commercial use, monetization, or brand-related usage is permitted unless explicitly licensed in writing by the photographer.
Usage scope (platform, duration, geography, media) must be defined in writing.
3. Restrictions
The Client may NOT:
Resell, sublicense, or redistribute the images. Alter, edit, or apply additional filters without prior written consent. Use the images to train artificial intelligence Remove watermarks or metadata (if applicable). Claim authorship of the images.
4. Editing & Artistic Control
All final images are delivered at the Photographer’s discretion. Editing style, color grading, and overall aesthetic—especially those processed through professional editing softwares—are considered part of the Photographer’s artistic signature and will not be altered after delivery unless agreed upon.
Images may not be altered, edited, filtered, or otherwise modified without prior written consent from the photographer.
5. Credit & Attribution
Where reasonably possible (especially online use), the Client agrees to credit:
“Photographed by Carina Wu – CW16Photo”
Any required credit must be clearly visible and not obscured, altered, or removed. The photographer’s name, logo, or watermark must remain intact where applied.
Tagging social accounts is appreciated but not mandatory unless specified.
6. Portfolio & Promotional Use
The Photographer retains the right to use all images for:
Portfolio (website, social media)
Marketing & promotional materials
Publications, exhibitions, or competitions
Unless the Client requests a written confidentiality agreement prior to the shoot.
7. Exclusive Rights
Exclusive usage rights or full copyright transfer are not included unless explicitly purchased and documented in writing. Additional fees apply.
8. Third-Party Usage
Any third-party use (brands, agencies, sponsors, media outlets) requires separate licensing and approval from the Photographer.
9. Jurisdiction Clause
These terms shall be governed by and interpreted in accordance with the laws of the applicable jurisdiction determined by the photographer.
10. Unauthorized Use
Unauthorized use of images constitutes copyright infringement and may result in legal action and additional licensing fees.
The photographer retains the right to object to any use of the images that may be considered derogatory, misleading, or harmful to their reputation or artistic integrity.
11. Revokation & Agreement
Any use of any images created by Carina Wu (CW16Photo) constitutes acceptance of these terms.
The photographer reserves the right to revoke any granted license in the event of a breach of these terms. Upon revocation, all use of the images must cease immediately.
1. Fan Project Usage & Collaboration Clause
Certain works created by the photographer may be designated as fan-related projects. These works are independently produced and are not affiliated with, endorsed by, or officially connected to any artists, management companies, or event organizers.
All fan-related images remain the property of the photographer and are subject to the same copyright and licensing protections as all other works.
Any individual, group, or organization wishing to use, integrate, reproduce, distribute, or collaborate using these images for their own fan projects or related activities must obtain prior written permission from the photographer. This includes, but is not limited to, use in fan merchandise, photobooks, social media distributions, event giveaways, or collaborative fan initiatives.
Unauthorized use, reproduction, or adaptation of fan-related works is strictly prohibited and may result in enforcement of copyright protections.
2. Event & Third-Party Restrictions Clause
Certain images may be captured in environments or under conditions that are subject to third-party rules, regulations, or restrictions, including but not limited to events, venues, private locations, or governed spaces.
The Client acknowledges that the use of such images may be limited or restricted by these third-party policies. The photographer makes no guarantee that all delivered images may be used freely in all contexts and shall not be held liable for any limitations, restrictions, or enforcement actions resulting from third-party regulations.
It is the responsibility of the Client to ensure that their intended use complies with all applicable rules, permissions, and legal requirements imposed by relevant third parties.
3. Limited Edition & Controlled Release Licensing
Certain works may be designated by the photographer as part of a limited edition or controlled release. This includes, but is not limited to, physical or digital products, collectibles, prints, publications, merchandise, or any form of distributed media.
All such works are produced and distributed in limited quantities and remain the intellectual property of the photographer. Purchase or possession of any limited edition item does not transfer copyright or grant any rights to reproduce, duplicate, modify, distribute, or commercially exploit the associated images or content.
Any reproduction, redistribution, or secondary use beyond the original intended format and distribution method is strictly prohibited without prior written permission from the photographer.
The photographer reserves the right to define, modify, or discontinue limited edition releases at their sole discretion.
4. License Grant Clause
All works remain the property of the photographer. Rights to use any images or content are not granted by default.
Following the negotiation and mutual agreement of usage terms, and upon fulfillment of agreed conditions (including payment where applicable), a non-exclusive, non-transferable, and revocable license may be granted for use strictly within the defined scope.
All usage parameters—including but not limited to purpose, platform, duration, geography, and media—must be explicitly agreed upon in writing. Any use beyond the agreed scope, or any modification, transfer, or redistribution of rights, requires prior written consent from the photographer.
The photographer reserves the right to approve, deny, or condition any usage at their sole discretion.
5. Copyright Clause
Refer to clauses and regulation specified above applies to all projects.
